These Terms & Conditions govern your use of the The Seasonal Press website and your purchase of products from us.

Please read them carefully before placing an order.

In these Terms & Conditions:

  • "The Seasonal Press", "we", "us" or "our" means The Seasonal Press.
  • "you" or "your" means the person accessing our website or purchasing a product from us.
  • "website" means www.theseasonalpress.com and any related pages, features or content operated by us.
  • "product" means any apparel, merchandise or other physical or digital product offered for sale through our website.
  • "Fulfilment Provider" means any third-party print-on-demand provider, manufacturer, print provider, production facility, warehouse, fulfilment provider, supplier, logistics provider or other service provider used by The Seasonal Press from time to time in connection with the production, processing, packaging, storage or delivery of products.

These Terms & Conditions should be read together with our Privacy Policy and any other policies or information displayed on our website that apply to your purchase.

USING OUR WEBSITE

You may use our website only for lawful purposes and in accordance with these Terms & Conditions.

You must not:

  • use our website for any unlawful, fraudulent or misleading purpose;
  • attempt to gain unauthorised access to our website, systems or data;
  • interfere with the operation or security of our website;
  • introduce malicious code, viruses or other harmful material;
  • use automated systems to scrape, copy or collect website content without our permission;
  • reproduce, copy or commercially exploit our website content without permission;
  • use our website in a way that could damage our business, reputation or systems; or
  • attempt to place orders using false, misleading or unauthorised information.

We may take reasonable steps to protect our website, customers and business from misuse or fraudulent activity.

CUSTOMER ACCOUNTS

The Seasonal Press currently operates through a checkout process that does not require customers to create or maintain a customer account.

You therefore do not need a username, password or customer account to place an order.

Order information may be retained and processed for purposes including:

  • fulfilling your order;
  • processing payments;
  • providing customer support;
  • handling returns, refunds or product issues;
  • complying with legal and accounting obligations; and
  • managing our business.

Our handling of personal information is explained in our Privacy Policy.

ELIGIBILITY TO PURCHASE

You must be legally capable of entering into a contract to purchase products from us.

If you are under the age required by applicable law to enter into a binding contract, you should only place an order with the involvement and permission of a parent or legal guardian.

By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the payment method provided.

OUR PRODUCTS

The Seasonal Press offers print-on-demand apparel and merchandise.

Many of our products are produced only after an order is placed. This means that products may not be manufactured or held as conventional pre-existing stock.

Depending on the product, destination, availability, production requirements and other operational factors, a product may be produced by different manufacturers, print providers or other Fulfilment Providers.

Product descriptions, artwork, graphics, colours, sizing information and images are provided to help you make an informed purchasing decision.

Some of our product designs, artwork, mockups and promotional images are generated or developed with the assistance of artificial intelligence (AI) tools. Product mockups may be digitally generated representations and may not show an actual photograph of the finished garment or a real person wearing the product.

We make reasonable efforts to ensure that our product listings accurately represent the products offered. However, please be aware that:

  • colours shown in mockups may differ from the finished product because of screen settings, device displays, garment colours, printing methods and production variations;

  • the appearance, shade, brightness, contrast and detail of a printed design may differ from the digital artwork or mockup;

  • the size, positioning, proportions and appearance of a printed design may vary slightly depending on the garment, size and printing process;

  • AI-generated model images and mockups may not precisely represent the appearance, fit, texture or drape of the actual garment; and

  • product measurements may have reasonable manufacturing tolerances.

We aim to provide accurate product descriptions and images, but the finished product may not look exactly like the mockup shown on our Site. We encourage you to review the product description, available colour options and sizing information carefully before ordering.

These differences do not automatically mean that a product is defective. However, this section does not exclude or limit your rights under the Australian Consumer Law if a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.

SIZING AND PRODUCT SELECTION

You are responsible for selecting the appropriate product, size, colour and other available options before placing your order.

We provide sizing information and charts where available and encourage you to check them carefully before purchasing.

Because our products are generally made to order, we do not ordinarily accept change-of-mind returns or exchanges because:

  • you selected the wrong size;
  • you selected the wrong colour;
  • you changed your mind;
  • the product does not fit in the way you expected; or
  • you no longer want the product.

This does not affect your rights where the product is defective, incorrectly supplied, materially different from its description, or otherwise fails to meet a consumer guarantee under applicable law.

PRODUCT AVAILABILITY

Products displayed on our website are subject to availability.

We may discontinue, modify or temporarily remove products without notice.

If a product becomes unavailable after you place an order and we cannot fulfil it, we will contact you and provide an appropriate solution, which may include a refund.

Nothing in these Terms permits us to accept payment for a product that we cannot supply without providing an appropriate remedy.

PRICES

Prices are displayed on the website at the time of purchase.

Unless otherwise stated, the price displayed for a product is the price applicable to that product at the time you place your order.

Prices may change from time to time. A price change will not affect an order that we have already accepted, except where an obvious pricing or listing error has occurred.

Where GST is applicable, it will be handled in accordance with applicable Australian taxation laws.

PRICING AND LISTING ERRORS

We take reasonable care to ensure that prices, product descriptions and other information displayed on our website are accurate.

However, an error may occasionally occur.

If we discover an obvious error in the price or product information relating to an order, we may contact you before fulfilling the order to explain the error and provide available options.

If the order cannot reasonably be fulfilled at the incorrect price or according to materially incorrect information, we may cancel the affected order and provide a refund of any amount you have paid.

This section does not apply to limit any rights you have under Australian law.

PLACING AN ORDER

You may place an order by selecting the products you wish to purchase and completing the checkout process.

Before submitting your order, you should carefully check:

  • product;
  • size;
  • colour;
  • quantity;
  • delivery address;
  • contact details;
  • email address; and
  • payment information.

By submitting an order, you are making an offer to purchase the selected products under these Terms & Conditions.

ORDER CONFIRMATION AND ACCEPTANCE

After you place an order, you may receive an automated order confirmation email.

An order confirmation acknowledges that we have received your order. It does not necessarily mean that your order has been finally accepted if circumstances require us to review or cancel the order.

Your order will generally be accepted when we confirm that it will be fulfilled or otherwise begin processing it.

Once accepted, a contract of sale exists between you and The Seasonal Press, subject to these Terms & Conditions and any rights provided by applicable law.

If we are unable to fulfil an accepted order, we will contact you and provide an appropriate remedy, including a refund where required.

PAYMENT

Payments for orders are processed securely through Stripe using the payment methods available at checkout.

You confirm that:

  • the payment information you provide is accurate;
  • you are authorised to use the payment method;
  • you are authorised to complete the transaction; and
  • the transaction is not fraudulent or unauthorised.

Payment card details are processed by Stripe and are not stored by The Seasonal Press. Payment processing is subject to Stripe's applicable terms, security measures and privacy practices.

If a payment is declined, reversed or cannot be successfully completed, we may be unable to process your order until payment has been successfully received.

Your order will not normally proceed to fulfilment until payment has been successfully completed.

PRINT-ON-DEMAND FULFILMENT

The Seasonal Press uses third-party print-on-demand fulfilment services to manufacture and fulfil many of our products.

Depending on the product, destination, availability, production requirements and other operational factors, we may use different Fulfilment Providers from time to time.

This means that:

  1. you place an order with The Seasonal Press;
  2. we submit the relevant order information to the applicable Fulfilment Provider;
  3. the product is produced specifically for your order;
  4. the product is packaged and dispatched by the applicable Fulfilment Provider and/or delivery provider; and
  5. you receive the product from the applicable delivery provider.

The use of a third-party Fulfilment Provider does not change the fact that your purchase is from The Seasonal Press.

Where there is a problem with a product or order, you should contact The Seasonal Press, rather than being required to deal directly with a Fulfilment Provider.

We may communicate with the applicable Fulfilment Provider on your behalf to investigate or resolve an issue.

MADE-TO-ORDER PRODUCTS

Because many products are manufactured specifically after an order is placed:

  • production may begin shortly after an order is submitted;
  • an order may not be capable of being cancelled once production has commenced;
  • products may not be resold as ordinary inventory after production;
  • change-of-mind returns are generally not available; and
  • product availability may depend on the availability of the relevant Fulfilment Provider, production facility or supplier.

These circumstances do not affect your rights under the Australian Consumer Law.

CHANGING OR CANCELLING AN ORDER

If you need to change or cancel an order, contact us as soon as possible at:

[email protected]

We will try to accommodate a request where practical.

However, because many products enter production shortly after an order is submitted, we may not be able to make changes or cancellations once production or fulfilment has commenced.

If we are unable to cancel or change an order because production has already commenced, this does not limit any rights you may have under the Australian Consumer Law.

If an order has already been dispatched, we generally cannot change the order or delivery address through our ordinary order process.

SHIPPING AND DELIVERY

Products are shipped using delivery services arranged through the applicable Fulfilment Provider and/or delivery provider.

Available shipping methods, estimated delivery times and applicable shipping charges will be displayed during checkout or otherwise communicated before purchase.

The production location, dispatch location, delivery carrier and available shipping method may vary depending on the product, destination, availability and other operational factors.

Delivery times are estimates only and may be affected by:

  • production time;
  • carrier delays;
  • weekends and public holidays;
  • peak seasonal periods;
  • weather events;
  • customs or border processing;
  • incorrect or incomplete delivery information;
  • events outside our reasonable control; or
  • other circumstances affecting the delivery network.

We do not guarantee that an order will arrive on a particular date unless we expressly state otherwise.

An order may be delivered in separate parcels where products are produced or dispatched through different facilities, providers or locations.

DELIVERY ADDRESS

You are responsible for providing a complete and accurate delivery address.

Please check your address carefully before submitting your order.

If an incorrect or incomplete address is provided, delivery may be delayed or the parcel may be returned to the applicable Fulfilment Provider or delivery provider.

Where a parcel is returned because of an incorrect or incomplete address, additional shipping or reshipment costs may apply before it can be sent again.

We will communicate with you about available options in these circumstances.

Where the problem was caused by an error on our part or by a fulfilment error, we will address the issue appropriately.

DELAYED, MISSING OR LOST ORDERS

If your order has not arrived within the expected delivery timeframe, contact us at:

[email protected]

Please provide your order number and any relevant delivery information.

We may investigate the shipment with the relevant Fulfilment Provider and/or delivery carrier.

Where an order is confirmed as lost in transit, we will provide an appropriate remedy in accordance with applicable law and the circumstances of the order.

We may also work with the relevant Fulfilment Provider or delivery provider to arrange a replacement or other resolution where available.

A delivery estimate passing does not automatically mean that a parcel is legally considered lost. We may need to allow a reasonable period for delivery investigation.

DAMAGED, DEFECTIVE, MISPRINTED OR INCORRECT PRODUCTS

If your order arrives:

  • damaged;
  • defective;
  • misprinted;
  • materially different from the product ordered;
  • with the wrong product;
  • with the wrong size supplied due to a fulfilment error; or
  • with another significant production or fulfilment problem,

please contact us as soon as reasonably possible at:

[email protected]

Please provide:

  • your order number;
  • a description of the problem; and
  • clear photographs where relevant.

Photographs may be particularly useful for damaged, defective or printing issues because they allow us and the applicable Fulfilment Provider to assess the problem.

Please do not send a product back to us unless we specifically instruct you to do so.

FULFILMENT PROVIDER CLAIM REQUIREMENTS

Our Fulfilment Providers may have their own operational requirements for reporting damaged, defective, misprinted, incorrectly supplied or undelivered products.

These requirements may include timeframes within which we need to report an issue to the applicable Fulfilment Provider in order to investigate the issue, obtain a replacement, request a refund or otherwise resolve the matter.

We therefore strongly recommend contacting The Seasonal Press promptly if you experience a problem with your order.

Where a Fulfilment Provider has a particular reporting timeframe, we may need to request information from you within that timeframe so that we can investigate the matter with the relevant provider.

Any such timeframe is an operational requirement of the relevant Fulfilment Provider. It is not intended to limit, exclude or replace any rights you may have under the Australian Consumer Law or other applicable law.

If you contact us outside an applicable provider reporting period, we will still consider your complaint and assess any rights or remedies that may apply.

REPLACEMENTS AND REFUNDS FOR PRODUCT PROBLEMS

If a product has a problem, we will assess the issue and determine the appropriate remedy in accordance with:

  • the circumstances of the problem;
  • the applicable Fulfilment Provider's processes;
  • these Terms & Conditions; and
  • applicable Australian law.

Depending on the circumstances, a remedy may include:

  • replacement;
  • repair where appropriate;
  • refund;
  • cancellation of the order;
  • reshipment; or
  • another appropriate solution.

Where Australian Consumer Law gives you a choice of remedy, we will respect that choice.

We will not require you to accept a replacement where Australian law gives you a right to reject the goods and obtain a refund instead.

NO GENERAL CHANGE-OF-MIND RETURNS

Because many of our products are produced specifically after an order is placed, we do not generally offer returns or exchanges simply because you:

  • changed your mind;
  • ordered the wrong size;
  • ordered the wrong colour;
  • do not like the product after receiving it;
  • no longer want the product;
  • ordered the wrong product; or
  • selected an item that does not fit as expected.

We strongly encourage you to check product descriptions and sizing information before ordering.

This policy applies only to genuine change-of-mind situations and does not affect your rights under the Australian Consumer Law.

AUSTRALIAN CONSUMER LAW

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where a product has a minor problem, we may be entitled to choose an appropriate remedy where permitted by law.

Where a product has a major failure, you may have the right to reject the product and choose a refund or replacement.

Australian Consumer Law rights may continue for a reasonable period depending on the nature, price and expected use of the product.

Our policies regarding change-of-mind returns, Fulfilment Provider reporting periods and other commercial policies do not replace or limit these statutory rights.

THE SEASONAL PRESS REMAINS YOUR POINT OF CONTACT

Although a Fulfilment Provider may manufacture, package or dispatch your product, your purchase is made from The Seasonal Press.

If you believe there is a problem with your product, please contact:

[email protected]

We may contact the applicable Fulfilment Provider, manufacturer, production facility, delivery provider or other service provider to investigate or resolve the issue.

You are not required to establish a separate customer relationship with a Fulfilment Provider in order to make a consumer guarantee claim against The Seasonal Press.

PHYSICAL RETURNS

The Seasonal Press does not currently operate a physical returns warehouse or customer-facing returns facility.

For many product problems, a physical return may not be necessary.

For example, where a product arrives damaged, defective or misprinted, we may ask you to provide photographs so that the issue can be assessed.

Where a physical return is required or appropriate, we will provide specific instructions about where and how the product should be returned.

Please do not send products to an address listed on a fulfilment provider's website or delivery documentation unless we have specifically instructed you to do so.

PRODUCTS RETURNED TO THE FULFILMENT PROVIDER

In some circumstances, a parcel may be returned to a Fulfilment Provider or delivery provider because of:

  • an incorrect address;
  • an incomplete address;
  • an unclaimed parcel;
  • a refused delivery;
  • customs issues; or
  • another delivery problem.

Where a parcel is returned, we will assess the circumstances and contact you where appropriate.

If the return occurred because incorrect or incomplete delivery information was provided by you, additional shipping costs may apply to reship the order.

If the return or delivery failure resulted from an error on our part or a fulfilment or carrier issue for which we are responsible, we will address the matter appropriately.

REFUND PROCESSING

Where a refund is approved, it will generally be processed using the original payment method where reasonably practicable.

Processing times may depend on:

  • our payment provider;
  • your bank or card issuer;
  • payment processing systems; and
  • the method originally used to pay.

We will not deduct an amount from a refund where doing so would unlawfully reduce a consumer's rights or statutory remedy.

Where a refund is required under Australian Consumer Law, we will process it in accordance with those requirements.

PROMOTIONAL CODES AND DISCOUNTS

From time to time, we may offer promotional codes, discounts or special offers.

Unless otherwise stated:

  • promotional codes must be entered at checkout;
  • only one promotional code may be used per order;
  • promotional codes cannot normally be applied retrospectively;
  • promotional codes may have expiry dates;
  • promotional codes may be subject to minimum purchase requirements;
  • promotional codes may exclude selected products;
  • promotional codes cannot normally be exchanged for cash; and
  • promotional codes may not be transferred or resold.

Promotions will be subject to any additional conditions displayed with the promotion.

Nothing in a promotion excludes or limits rights under Australian Consumer Law.

SALE PRODUCTS

Products offered at a sale or discounted price remain subject to these Terms & Conditions and applicable consumer law.

A product being discounted does not remove or reduce your Australian Consumer Law rights where the product has a problem that is not the disclosed reason for the discount.

If a particular defect or limitation has been clearly disclosed before purchase and the product is purchased knowing about that specific issue, applicable law will determine what rights apply to that issue.

GIFT CARDS OR GIFT VOUCHERS

If we offer gift cards or gift vouchers in the future, additional terms may apply to them.

Any expiry period, redemption conditions, exclusions and other applicable terms will be clearly communicated at the time of purchase.

Gift cards and vouchers will be handled in accordance with applicable Australian consumer and gift-card laws.

PRE-ORDERS

If we offer pre-order products, the relevant product page or checkout information will identify the product as a pre-order and provide an estimated production or dispatch timeframe where reasonably available.

Pre-order dates are estimates unless expressly stated otherwise.

If we are unable to supply a pre-order, we will provide an appropriate remedy in accordance with applicable law.

Pre-order terms do not override Australian Consumer Law.

PRODUCT CARE

You are responsible for following any product-care instructions supplied with a product or displayed on our website.

Product-care instructions may include information regarding:

  • washing;
  • drying;
  • ironing;
  • bleaching;
  • detergents;
  • heat;
  • storage; and
  • other appropriate care.

Damage caused by misuse, improper care, accidents or failure to follow reasonable care instructions may not constitute a manufacturing defect.

This does not affect any consumer guarantee that cannot lawfully be excluded.

INTELLECTUAL PROPERTY

Unless otherwise stated, all intellectual property associated with The Seasonal Press website and brand belongs to or is licensed to The Seasonal Press.

This includes, where applicable:

  • logos;
  • brand names;
  • graphics;
  • illustrations;
  • product designs;

  • mock-ups;
  • text;
  • website layouts;
  • marketing materials;
  • product descriptions;
  • original artwork; and
  • other creative content.

You must not copy, reproduce, modify, distribute, sell, licence, publish or commercially exploit our intellectual property without our prior written permission.

Purchasing a product does not transfer ownership of the underlying artwork, design or intellectual property to you.

You may use a purchased physical product for ordinary personal purposes, subject to applicable law.

CUSTOMER REVIEWS, PHOTOS AND OTHER CONTENT

If you voluntarily submit a review, photograph, testimonial, comment or other content to us, you confirm that:

  • you have the right to provide that content;
  • the content does not infringe another person's intellectual property, privacy or other rights;
  • the content is not unlawful, defamatory, misleading or abusive; and
  • you have obtained any necessary permission from identifiable people shown in the content.

You grant The Seasonal Press a non-exclusive, royalty-free licence to use, reproduce, display and publish the submitted content for purposes connected with our business, including displaying customer reviews, testimonials and customer photographs on our website, social media, advertising and marketing materials, in accordance with these Terms and our Privacy Policy.

We may remove or decline to publish submitted content at our discretion where reasonably appropriate.

We do not guarantee that customer-submitted content will be published.

PHOTOS INVOLVING CHILDREN

Please do not submit photographs containing children unless you are authorised to provide the photograph and permit its use.

If you submit a photograph containing a child, you confirm that you have the necessary authority and permissions to submit it and to grant the rights described in these Terms.

Our Privacy Policy contains further information about how personal information and photographs are handled.

PROHIBITED CUSTOMER CONTENT

You must not submit content that:

  • infringes copyright, trademarks or other intellectual property rights;
  • is unlawful, threatening or defamatory;
  • contains hate speech;
  • promotes violence or illegal activity;
  • contains another person's private or confidential information without permission;
  • is fraudulent or misleading;
  • contains malicious code;
  • is sexually explicit, pornographic, or depicts nudity in a sexually explicit or inappropriate manner; or
  • otherwise violates applicable law.

We may remove or decline to publish content that we reasonably believe breaches these requirements or is otherwise inappropriate for The Seasonal Press, our website, social media or marketing channels.

THIRD-PARTY SERVICES

We use third-party businesses and technology providers to operate our store and fulfil orders.

These may include, depending on the services we use:

  • ecommerce and website platforms;
  • payment processors;
  • print-on-demand providers;
  • manufacturers and production facilities;
  • fulfilment and warehousing providers;
  • delivery and logistics providers;
  • email service providers;
  • customer review and support services;
  • analytics providers; and
  • other technology or business service providers.

These third parties may process information necessary to provide their services.

Further information about these providers and the handling of personal information is provided in our Privacy Policy.

THIRD-PARTY WEBSITES AND LINKS

Our website may contain links to third-party websites or services.

These links may be provided for convenience or informational purposes.

We do not control third-party websites and are not responsible for their content, availability, security, privacy practices or terms.

Your use of third-party websites is subject to the terms and policies of those third parties.

WEBSITE AVAILABILITY

We aim to keep our website available and operating reliably, but we do not guarantee that the website will always be:

  • available;
  • uninterrupted;
  • error-free;
  • secure from every possible threat; or
  • free from technical problems.

We may temporarily suspend or restrict access to parts of the website for:

  • maintenance;
  • updates;
  • security reasons;
  • technical problems;
  • improvements;
  • emergencies; or
  • other reasonable operational purposes.

WEBSITE INFORMATION AND ERRORS

We make reasonable efforts to ensure that information on our website is accurate and current.

However, information may occasionally contain:

  • typographical errors;
  • technical errors;
  • outdated information;
  • product availability errors;
  • pricing errors; or
  • other inaccuracies.

We may correct errors or update information where appropriate.

Nothing in this section limits any legal rights you have where inaccurate information has resulted in a breach of applicable law.

PRIVACY

Our Privacy Policy explains how we collect, use, disclose, store and protect personal information.

By using our website or placing an order, you acknowledge that your information will be handled in accordance with our Privacy Policy.

Our Privacy Policy is available on our website.

WEBSITE SECURITY

We take reasonable steps to protect our website and the information handled through it.

However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

You should take reasonable precautions when accessing our website, including using appropriate device security and keeping your own devices and accounts secure.

You must not attempt to bypass or interfere with our security systems.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not responsible for loss or damage arising from:

  • your misuse of the website;
  • your failure to provide accurate information;
  • your failure to follow reasonable product-care instructions;
  • events outside our reasonable control; or
  • your use of third-party websites or services.

However, nothing in these Terms & Conditions excludes, restricts or modifies:

  • any right or remedy that cannot lawfully be excluded;
  • any consumer guarantee under the Australian Consumer Law;
  • liability that cannot legally be limited; or
  • liability for reasonably foreseeable loss or damage where the law requires compensation.

Where our liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.

EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, including:

  • natural disasters;
  • extreme weather;
  • fire;
  • flood;
  • epidemic or pandemic;
  • industrial action;
  • transportation disruptions;
  • postal or courier disruptions;
  • telecommunications or internet failures;
  • cyber incidents beyond our reasonable control;
  • government restrictions;
  • war or civil unrest;
  • supplier or fulfilment disruptions; or
  • other events that could not reasonably have been prevented or controlled.

Where such an event affects an order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.

This clause does not remove any rights you may have under Australian Consumer Law.

PRODUCT SAFETY AND RECALLS

We take product safety seriously.

If we become aware of a product safety issue, recall, mandatory safety action or other significant safety concern affecting a product you purchased from us, we may contact you using the information associated with your order.

You agree to reasonably cooperate with safety-related instructions where necessary.

Where a product is subject to a legally required recall or safety remedy, we will provide the remedy required by applicable law.

FRAUDULENT OR ABUSIVE ACTIVITY

We may take reasonable steps where we reasonably suspect:

  • payment fraud;
  • unauthorised use of a payment method;
  • repeated fraudulent claims;
  • abuse of promotional offers;
  • false or misleading information;
  • attempts to exploit our policies;
  • malicious activity; or
  • other unlawful conduct.

Where appropriate, we may delay processing an order while investigating suspected fraud or security issues.

We will not use this section to avoid legitimate consumer guarantee obligations.

CHARGEBACKS AND PAYMENT DISPUTES

If you believe there is a problem with an order or payment, we encourage you to contact us at:

[email protected]

We will make reasonable efforts to investigate and resolve genuine disputes.

Nothing in these Terms prevents you from exercising any rights you have through your bank, card provider, payment provider or applicable law.

SUSPENSION OR TERMINATION OF WEBSITE ACCESS

We may suspend or restrict access to our website where reasonably necessary, including where there is:

  • suspected fraud;
  • a security threat;
  • unlawful activity;
  • abuse of our systems;
  • technical risk; or
  • another legitimate operational or security reason.

Any suspension or restriction will not affect rights or obligations that have already arisen from an accepted order, except where permitted by law.

CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time.

The latest version will be published on our website with the applicable "Last updated" date.

Changes will generally apply from the date they are published and will not retrospectively change the terms of an order that we have already accepted, unless required or permitted by law.

If a significant change materially affects an existing legal relationship, we will take reasonable steps to communicate the change where appropriate.

SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary.

The remaining provisions will continue to operate to the extent permitted by law.

NO WAIVER

If we do not immediately enforce a right or provision under these Terms & Conditions, this does not mean that we have permanently waived that right or provision.

Any waiver must be considered in the circumstances in which it is given.

GOVERNING LAW

These Terms & Conditions are governed by the laws of Victoria, Australia.

Subject to any mandatory rights or jurisdiction that cannot lawfully be excluded, disputes relating to these Terms & Conditions or purchases from The Seasonal Press will be subject to the courts and tribunals of Victoria, Australia.

Nothing in this section prevents a consumer from exercising rights under applicable Australian consumer protection laws or accessing a forum or tribunal that has mandatory jurisdiction.

IMPORTANT AUSTRALIAN CONSUMER LAW NOTICE

For clarity, nothing in these Terms & Conditions is intended to exclude, restrict or modify rights or remedies available to consumers under the Australian Consumer Law or any other law that cannot legally be excluded, restricted or modified.

Where a provision of these Terms & Conditions conflicts with a mandatory legal right, the mandatory legal right will prevail to the extent of the inconsistency.
